Provider Alert! EVV Update: Information Letter (IL) for Financial Management Services Agencies (FMSAs)

Call to action:

Health and Human Services Commission (HHSC) has extended the Electronic Visit Verification (EVV) practice period through December 31, 2020. This allows Consumer Directed Services (CDS) employers to learn more about using the EVV system. During the practice period, EVV claims will not be denied for a mismatch.

Beginning January 1, 2021, all service visits for an EVV-required service must be captured in the EVV system. Claims without a matching EVV visit transaction accepted into the EVV Portal will be denied for payment.

How this impacts providers:

The Health and Human Services Commission (HHSC) published an Information Letter (IL) for Financial Management Services Agencies (FMSAs). The IL informs FMSAs that a CDS employer may delegate the performance of EVV visit maintenance to the FMSA and reminds FMSAs about EVV vendor selection and training requirements. The CDS employer indicates their selection for EVV responsibilities on Form 1722, Employer’s Selection for Electronic Visit Verification Responsibilities. The IL also includes a notice for CDS employers, which explains EVV requirements.

Next steps for providers:

  • Review the information letter (IL) (revised November 18, 2020) published by the HHSC (see link below):
  • The IL directs FMSAs to do the following for CDS employers who do not complete and return Form 1722 to the FMSA by Nov. 30, 2020:
    • Document that the CDS employer was provided Form 1722 but did not submit a completed form by Nov. 30, 2020; and
    • Perform EVV visit maintenance, as described in Option 3 on the form, until the CDS employer submits the completed form to the FMSA.
  • FMSAs were required to provide notice to CDS employers by August 31, 2020.
